I have reviewed the installation of my OMUfibernet equipment and service connection by OMU or its designated contractor(s) and I agree that my requested service has been installed to my satisfaction. I also understand the same billing and payment terms agreed to in my original OMU service contract also apply to these services and that any equipment provided to me for the delivery of services is and will remain the property of OMU. I assume full responsibility for any damage to the OMU equipment resulting from negligence, misuse, or other cause while it is assigned to my premises and account, whether my account is active or inactive. Upon discontinuance or disconnection of my service, I agree to return the Optical Network Terminal (ONT) to OMU in good condition, within 7 days or I will incur an equipment charge of $300. If the ONT is returned to OMU in good condition within 60 days of disconnection, the $300 equipment charge will be credited back to me. No credit will be given if the equipment is returned in a damaged condition.
I understand that the installation of advanced fiber infrastructure used to provide services to my home requires a significant investment by OMU. Installations generally include fiber drops, gateways, wall plates, fiber slicing, conduit installation, and other capital investments. The basic installation fee does not offset the entire cost of installation, however, OMU is willing to waive the remainder of these fees if the customer maintains active services with OMU for a minimum period of one (1) year after the date of installation and inception of service. Therefore, I understand that OMU is conditionally waiving any additional installation costs for my commitment to remain an active subscriber for a minimum of twelve (12) months following the installation of service. If I voluntarily terminate services prior to one year for any reason other than for failure of the service to perform as represented by OMU, I agree to pay the balance of the prorated cost of installation for my service and agree that it may be applied to my final invoice. The prorated charge will be calculated as follows: (($450/12)* # of months remaining) = charge.
I have agreed to allow OMU personnel and/or their designated contractor(s) access to my property for the purpose of installing, adjusting, repairing, replacing, maintaining, moving, auditing, or removing any service-related equipment as necessary at reasonable times and upon reasonable notice. I represent that I am the property owner, or if I am not, I certify that I have obtained any necessary permission or consent from the property owner to allow OMU to provide the services and conduct the activities described herein. I agree to indemnify and hold OMU harmless from any liability or costs that OMU incurs, including attorneys’ fees, resulting from my failure to obtain the necessary authorization(s) required for OMU’s services and I understand that I am responsible for reimbursing OMU for these costs.
I understand OMU is not responsible for the maintenance, operation, service, or repair of any customer-owned equipment including televisions, computers, routers, telephones, or any other connected device. I also understand this service is provided for residential use only and could be subject to suspension or disconnection for any improper use that may cause excessive latency or network congestion such as video or large-scale web hosting, BitTorrent or similar software, etc.
